1. Acceptance and amendment of the Terms of Use
1.1 Your visit to and use of the websites of DDKgroup Ltd (AG) (“Desta's Coffee”), which includes all companies affiliated with Desta's Coffee (“Websites”), is subject to these Terms of Use (“Terms of Use”). By visiting, browsing and using our Websites, you acknowledge that you have read, understood and unconditionally accepted the Terms of Use, which we may change from time to time.

1.2 If we make changes to our Terms of Use, we will upload the new version to our websites. We therefore ask you to consult the Terms of Use from time to time to take note of any changes.

2. Copyright and intellectual property
2.1 The content of our Websites and in particular, but not exclusively, the texts, trademarks, logos, graphics, photographs, videos, sounds, music, designs, drawings, know-how, technologies, products and processes, are the property of Nespresso or its affiliated companies, or are used with the consent of their owners, and are protected by the corresponding copyrights, trademarks, patents and all other intellectual or industrial property rights to which they are entitled under the applicable laws.

2.2 Subject to the provisions of Article 3 below, no element of our Websites may be construed as granting a license or right of use to any element displayed on these same Websites.

3. Use of the Websites
3.1 You are authorized to download, view or print the content of our Websites solely for your personal and non-commercial use, provided that you retain and reproduce all copyright and other intellectual property notices contained in any content or other materials you download. Any other use, including the reproduction, modification, distribution, transmission or dissemination of the elements of the Websites, whether in whole or in part and regardless of the method of reproduction used, is expressly prohibited without the prior written consent of Desta's Coffee.

3.2 Desta's Coffee does not guarantee that the use of content published on its websites will not infringe the rights of third parties.

4. Non-confidential information
4.1 All data and information that can be traced back to you and that you transmit to our websites via the Internet is protected and will be treated in accordance with our confidentiality guidelines. We ask you to read these confidentiality guidelines carefully before you entrust us with data and information that could allow us to identify you personally.

4.2 Any other information or material you transmit to Desta's Coffee via the Internet by electronic mail or otherwise, including any data, questions, comments, suggestions, ideas, graphics, etc., will be treated as non-confidential and non-proprietary. Anything you transmit or upload becomes the property of Desta's Coffee and may be used for any purpose whatsoever, including, but not limited to, reproduction, disclosure, transmission, publication, performance and posting. In particular, Desta's Coffee shall be free to use any ideas, concepts, know-how or techniques contained in any communication you send to the Site for any purpose whatsoever including, but not limited to, developing, manufacturing, advertising and commercializing products using such information. The use of such information submitted by you does not entitle you or any third party to any compensation.

4.3 If you submit information, you warrant that the submitted material is your property, that it is not defamatory and that its use by Desta's Coffee will not infringe the rights of any third party. Desta's Coffee is under no obligation to use the information submitted.

5. Exclusion of warranties
5.1 Without limiting the scope of Article 6 below, all material, information and anything you find on the Websites is provided “as is”, where available and without warranty of any kind, whether express or implied, including but not limited to the implied warranties of merchantability or fitness for a particular purpose.

5.2 Desta's Coffee does not warrant that its websites or their contents will meet your expectations or that they will be uninterrupted, adequate, secure or free from errors.

5.3 Because some jurisdictions do not allow certain limitations on warranties, some of the above exclusions may not apply to you.
5.4 No advice or information, whether oral or written, obtained from Desta's Coffee during the use of the Services or provided on the Websites shall create any warranty not expressly stated in these Terms of Use.

6. Limitation of liability
6.1 You visit and use our websites and navigate them at your own risk.

6. 2 You acknowledge and accept that Desta's Coffee, its affiliated companies or the companies that have participated in the design, production or delivery of the websites cannot be held liable for any direct, indirect or incidental damages to the fullest extent permitted by applicable law, or for any damage to reputation, costs, losses, reductions in turnover or profits or revenue of any kind (even if Desta's Coffee was aware or could have foreseen the occurrence of a disadvantage) that may result from the use or, on the contrary, the inability to use the websites or their content.

6.3 All materials downloaded or otherwise obtained through the use of our websites are at your own risk. Desta's Coffee accepts no responsibility for any damage or virus that may infect your computer equipment or computer systems as a result of visiting or using the Websites or downloading any material from the Websites, or for any unauthorized intrusion into your computer systems.

7. change of information
The content of our websites may contain inaccuracies or errors. Desta's Coffee reserves the right to change, correct or improve said content at any time and without notice, but assumes no obligation to do so.

8. Availability of products / services
Our websites may contain information about Desta's Coffee products and services that are not necessarily available everywhere. A reference to Desta's Coffee products or services on its websites does not imply that they are available where you live.

9. Links
9.1 As a service to our visitors, our websites may contain links to other websites on the Internet that are neither operated nor controlled by Desta's Coffee. Desta's Coffee cannot accept any responsibility for these websites and disclaims any liability for their content, legality, accuracy and function.

9.2 The creation of links to our websites is prohibited without the prior written consent of Desta's Coffee.

10. Miscellaneous
10.1 These Terms of Use constitute the entire agreement between Desta's Coffee and you with respect to your visit to and use of the Websites and their content. Any additional terms established by Desta's Coffee to govern its relationship with you, particularly with respect to a service or the purchase of a product, are in addition to these Terms of Use; if there is any conflict between them, the additional terms shall prevail.

10.2 The fact that Desta's Coffee tolerates that you do not fulfill any of the obligations arising from the Terms of Use, or that Desta's Coffee waives any right granted to it by these Terms of Use or by law, can in no way be interpreted as a waiver of the enforcement of its rights.

10.3 In the event that a clause of the Terms of Use were to be considered unlawful by virtue of an existing or future legal or regulatory provision or a court decision, the said clause would be considered unwritten, with all other clauses of the Terms of Use remaining in full force and effect.

10.4 The title to the articles of the Terms of Use is merely indicative and cannot affect or modify the provisions in any way.
