Scope of this Policy

Please read this Privacy Policy (“Policy”) carefully so that you understand our policies and practices regarding your personal data and how we will treat it.

This Policy explains how your personal information is collected, used and shared by Desta's Coffee business units as listed in the “Data Controllers and Contact Details” section (Section 11) (“Desta's Coffee”, “we”, “us”, “our”). It also provides information about how you can access and change your personal data and how you can make certain choices about how your personal data is used.

This Policy applies to the online collection of data, including personal data, that we collect through various channels such as websites, apps, third party social networks, customer relationship centers, points of sale and events. Please note that we combine personal data that we collect through one method (e.g. a Desta's Coffee website) with personal data that we collect through another method (e.g. a Desta's Coffee event outside of the internet). In doing so, we combine personal data originally collected by different Desta's Coffee business units. For more information on how you can opt out of this practice, please see Section 8.
If you do not provide us with the required personal data (which we will inform you of where appropriate, for example by marking this information on our registration forms), we will not be able to provide you with our products and/or services. This policy may be amended from time to time (see section 10).

1.     Source of personal data

This policy applies to personal data that we collect from or about you using the methods described below (see section 2) from the following sources:

Desta's Coffee websites. Customer-facing websites operated by or for Desta's Coffee, including websites we operate under our own domains/URLs and mini-sites we operate on third-party social networks, such as Facebook (“Websites”).

Desta's Coffee mobile websites/apps Customer-facing mobile websites or applications operated by or for Desta's Coffee, such as smartphone apps.

Emails, text messages and other electronic messages. Electronic communications between you and Desta's Coffee.

Desta's Coffee support. Calls to our Customer Relationship Centers.

Offline registration forms. Registration and similar printed forms that we receive, for example, through the mail, in-store presentations, contests and other promotions or events.

Points of sale. People who are present in third-party stores to help you register your coffee machine and order coffee.

Data from other sources. Third party social networks (such as Facebook, Google) or market studies (if feedback is not given anonymously).

 

2.     Personal data we collect about you and how we collect it

Depending on the nature of your interaction with Desta's Coffee (online, offline, over the phone, etc.), we may collect different types of information from you as described below.

Personal Contact Information. This includes information you provide to us that we may use to contact you, such as your name, postal address, email address, social network account details or phone number.

Login details for your account. Any data required for you to access your specific account profile. Examples include your username, email address, screen name, password in non-recoverable form and/or a security question and answer.

Demographic information and interests. Any information that relates to your demographics or behavior. Examples include your date of birth, age or age range, gender, geographic location (e.g. ZIP code), favorite products, hobbies and interests, and household or lifestyle information.

Technical information about your computer or mobile device. Any information about the computer system or other technical device you use to access one of our websites or apps, for example, the IP (Internet Protocol) address used to connect your computer or device to the Internet, the type of operating system or the type and version of your web browser. If you access a Desta's Coffee website or app via a mobile device, such as a smartphone, information such as your phone's device ID, advertising ID, your location or other similar data about your mobile device will also be collected where permitted.

Information about the use of websites/communication methods.As you navigate through or interact with our websites or newsletters, we use automatic data collection technologies to collect certain information about your activities.This includes information such as the links you click, the pages and content you view and how long you view them, and other similar information and statistics about your interactions, such as content response times, download errors and length of visits to certain pages. This information is collected using automated technologies such as cookies (browser cookies, Flash cookies) and tracking pixels, as well as third-party tracking methods. You have the right to actively object to the use of such technologies. Further details can be found in section 3.

Market research and customer feedback. This includes information that you voluntarily provide to us about your experience of using our products and services.

Customer-generated content.This includes any content that you create and then share with us on third party social networks or that you upload to any of our websites or apps, including the use of third party social networking apps such as Facebook. Examples include photos, videos, personal stories or other similar media or content. Where permitted, we collect and publish customer-generated content in connection with various activities, including sweepstakes and other promotions, community features on websites, customer promotions and activities on third-party social networks.

Information on third party social networks. This includes any information that you share publicly on a third party social network and information that is part of your profile on a third party social network (such as Facebook) that the third party social network may share with us with your permission. Examples include your general account information (e.g. name, email address, gender, date of birth, current location, profile picture, user ID, friends list) and any other additional information or activity that the third party social network may share with your permission. We receive the information about your profile on a third party social network (or portions thereof) each time you download or interact with a Desta's Coffee web application on a third party social network such as Facebook, each time you use a social network feature that is embedded on a Desta's Coffee website (such as Facebook Connect), or each time you interact with us through a third party social network.To learn more about how Desta's Coffee receives your information from a third-party social network, or how you can actively opt-out of sharing such information on social networks, please visit the relevant third-party social network's website.

Payment and financial information. Any information that we need to fulfill an order or that you use when making a purchase, for example the details of your debit or credit card (cardholder name, card number, expiration date, etc.) or other payment methods (if available). In any case, we or our payment service providers handle payment and financial information in accordance with all applicable laws, regulations and security standards such as PCI DSS.

Calls to our support. Communications with our support will be recorded or partially listened to in accordance with applicable laws for local business requirements (e.g. for quality or training purposes). Payment card details will not be recorded. Where required by law, you will be informed of such recordings at the beginning of your call.

 

3.     Cookies / similar technologies, log files and tracking pixels

Cookies/similar technologies. Please read our Cookie Policy for more information on how you can change your cookie settings, what cookies we use and for what purposes we use them.

Log files. We collect information in the form of log files that record website activity and compile statistics about your browsing behavior.

This data is generated automatically and helps us to correct errors, improve our performance and ensure the security of our websites.

Tracking pixels. Tracking pixels (also known as “web bugs”) are small strings of code in the form of a small graphic on a website or in an email to transmit data back to us. The information collected via tracking pixels is information such as IP address and your response to an email campaign (e.g. when the email was opened, which links you clicked on in the email). We use tracking pixels on our website or integrate them into emails that we send you. We use information collected through tracking pixels for various purposes, including website traffic reports, visitor numbers, advertising, email reviews and reports, and personalization.

These are cookies that are absolutely necessary for the operation of the website. Without these cookies, the website will not work properly.

 

Funcionality Cookies

These cookies are intended to improve the functionality of the website, e.g. cookies that remember the content previously viewed on this website or the e-mail address and password you entered when logging in on a previous visit. What we use your personal data for:

Order processing. We use your personal data to process and ship your orders, to inform you about the status of your orders, to correct addresses, to verify your identity and for other fraud detection measures. This includes the use of certain personal data and payment information.

Other general purposes (e.g. internal studies or market research, analytics, security). We use your personal data in accordance with applicable laws for other general business purposes such as conducting internal or market research and measuring the effectiveness of advertising campaigns. If you have multiple accounts as a club member, we reserve the right to merge these accounts into a single account. We also use your personal data for your security.

What we use your personal data for:

Legal reasons or merger/acquisition. If Desta's Coffee or its assets are acquired by or merged with another company, including as a result of bankruptcy, we will share your personal information with our successors in interest. We will also transfer your personal information to other parties (i) if we are required to do so by law, (ii) in response to legal process, (iii) in response to a request from a competent law enforcement authority, (iv) to protect our rights, privacy, safety, property or the public, or (v) to enforce the terms of an agreement or the terms of our website.

What we use your personal data for:

Personalization (offline and online). With your consent (where required), we use your personal data (i) to analyze your preferences and habits, (ii) to predict your preferences by analyzing your profile, (iii) to improve and personalize your experience on our website and apps, (iv) to ensure that the content on our websites/apps is optimized for you and your computer or device, (v) to provide you with targeted advertising and content, and (vi) to allow you to use interactive features if you choose to do so. Example: We store your username/email address or screen name so that you can quickly log in the next time you visit our website, or so that you can easily access items you have already added to your shopping cart. Based on this type of information and with your consent (if required), we will also show you specific Desta's Coffee content or promotions tailored to your interests. The use of your personal data is voluntary, which means that you can object to the processing of your personal data for this purpose. You can find more information about your right to object in section 8 below.

 

5. Disclosure of your personal data

In addition to the Desta's Coffee /DDKgroup Ltd business units or, on a case-by-case basis, domestic business partners (engaged in Desta's Coffee operations) as listed in the "Data Controllers and Contact Details" section (see Section 11), we also transfer your personal data to the following types of third party organizations:

Service providers. These are external companies that we use to help us with our business (e.g. order fulfillment, payment processing, fraud detection and identity verification, website operation, market research companies, support services, promotions, website development, data analysis, customer relations). Service providers and their selected employees may access and use your personal data on our behalf only in accordance with our instructions and only for the specific tasks they have been engaged to perform and must keep your personal data confidential and secure. Where required by law, you may request a list of the service providers that process your personal data (see section 11 to contact us).

Credit agencies/collection agents. To the extent permitted by law, credit agencies and debt collection agencies are external companies that we use to help us check your creditworthiness (especially for orders with payment by invoice) or to help us collect invoice amounts due.

Third party companies that use personal data for their own marketing purposes. Except where you have given your consent, we do not license or sell your personal data to third parties for their own marketing purposes. We will disclose the identity of such third parties at the time we obtain your consent.

Third party recipients who use personal data for legal reasons or due to a merger/acquisition. We transfer your personal data to third parties for legal reasons or as part of an acquisition or merger (see section 4 for details).

 

6. Storage of personal data

In accordance with applicable laws, we will use your personal data for as long as necessary to fulfill the purposes for which your personal data was collected (as described in Section 4 above) or to comply with applicable legal requirements.

Personal data used to provide you with a personalized experience (see section 4 above for details) will be retained for the period of time permitted by law.

 

7. Disclosure, storage and/or transfer of your personal data

We use a variety of appropriate measures (as described below) to keep your personal information confidential and secure. Please note, however, that these safeguards do not apply to information that you share in public areas such as on third-party social networks.

Persons who can access your personal data. Your personal data will be processed by our authorized employees or agents to the extent necessary depending on the specific purposes for which your personal data was collected (e.g. our employees working in customer service will have access to your customer file). Measures taken in operating environments. We store your personal data in operating environments that have appropriate security measures in place to protect against unauthorized access. We maintain appropriate standards to protect personal data. Unfortunately, the transmission of information via the internet is not completely secure and, while we will do our best to protect your personal data, we cannot guarantee the security of your data during transmission via our websites/apps.

Measures you should take. It is important that you also take a role in protecting your personal data. When registering for an online account, you should be sure to choose a password that is difficult for others to guess and you should never entrust your password to another person. You are responsible for keeping this password confidential and for the use of your account. If you share a computer with another person or use a public computer, you must never save your username/email address or password and you must ensure that you log out of your account each time you leave the computer. You should also use any privacy settings or controls that we make available to you on our website/app.

 

8. Access to your personal data

Access to Personal Information. To the extent permitted by law, you, your successors, assigns and/or agents have the right to access, review or request a physical or electronic copy of the information we hold about you. You also have the right to request information about the source of your personal data.

You can exercise these rights by contacting us using the contact form available at www.destascoffee.ch. You can also write to us at DDKgroup Ltd, Europastrasse 4, 8152 Glattbrugg, enclosing a copy of your ID or relevant details (if requested by us and permitted by law). If the request is submitted by someone other than you without you providing evidence that the request was legitimately submitted on your behalf, the request will be rejected.

Please note that any identifying information you provide to us will only be processed in accordance with applicable laws and to the extent permitted by law.

Other rights (e.g. modification, deletion of personal data). To the extent permitted by law, you, your successors, assigns and/or authorized agents may (i) request erasure, portability, correction or modification of your personal data, (ii) object to the processing of the data, (iii) restrict use and disclosure of your personal data, and (iv) withdraw your consent to any of our data processing activities.

Please note that in certain circumstances we may not be able to delete your personal data without also deleting your user account. Even after your deletion request, we may still need to retain some of your personal data to fulfill our legal and contractual obligations. We may also be permitted by applicable law to continue to store some of your personal data for our business needs.

In some places, our websites have a special feature that allows you to review and edit the personal information you have provided. Please note that we require our registered customers to verify their identity (e.g. login ID/email address, password) before they can access or make changes to their account information. This facilitates the prevention of unauthorized access to your account.

Where available, there is a dedicated function on our websites that allows you to review and edit the personal data you have provided. Please note that customers registered with us must prove their identity (e.g. username/email address, password) if they wish to access or change their account information. This enables us to prevent unauthorized access to your account.

9. Your choices about how we use and share your personal data

We are committed to giving you the opportunity to decide how we use the personal data you provide to us. The mechanisms listed below give you the following control over your personal data:

Cookies/similar technologies. You manage your consent through (i) our consent management solution or (ii) your browser to refuse all or some cookies/similar technologies or to notify you when they are used. See section 3 above.

Advertising, marketing and promotions. If you want Desta's Coffee to use your personal data to promote its products or services, you can check the appropriate box(es) on the registration form or answer the question(s) asked by our staff during presentations, when calling our support. If you no longer wish to receive such communications in the future, you can opt out of receiving marketing-related communications at any time. To do so, follow the instructions contained in such communications. To stop receiving marketing communications from any medium in the future, including third party social networks, you can opt out at any time. To do so, log in to the websites/apps or third-party social networks and deactivate your user settings in your account profile. Please note: Even if you opt out of receiving marketing communications, you will still receive administrative communications from us, such as order confirmations or confirmations for other business transactions, notifications regarding your account activity (e.g. account confirmations, password changes) and other important non-marketing related announcements.

Personalization (offline and online) If you want Desta's Coffee to use your personal data to provide you with a personalized experience or targeted advertising and content, where permitted by law, you can tick the relevant box(es) on the registration form or answer the question(s) asked by our staff at presentations, when you call a CRC or in a boutique. If you no longer wish to receive marketing communications from a medium in the future, you can object at any time. To do this, log in to the websites/apps and uncheck the relevant boxes in your account profile or call our CRC.

Interest-based advertising. We work with advertising networks and other advertising providers ("Advertisers") that advertise on the Internet on our behalf and on behalf of other companies that are not affiliated with us. Some of these advertisements are customized to your interests based on information collected over time on Desta's Coffee websites or on websites of unaffiliated companies. You can visit www.aboutads.info/choices to learn more about this type of advertising and for information on how to opt-out of the use of interest-based advertising methods by companies participating in the Digital Advertising Alliance ("DAA") self-regulatory program. In addition, you can opt out of the use of this type of advertising in mobile applications from companies that are part of the DAA's AppChoices app. To do this, please download the app from the iOS or Android app store. You can also prevent precise location data from being collected from a mobile device. To do this, change the location detection settings on your device.

 

10. Change to our guideline

If we change the way we process your personal data, we will update this policy. We reserve the right to change our practices and this policy at any time. Therefore, please check this page regularly for changes and updates to our policy.
